UNIVERSITY OF SOUTHERN MAINE Voluntary Dining Membership Terms and Conditions for 2009-2010
The voluntary dining membership is a license agreement between the University of Maine System, acting through the University of Southern Maine (”University”) and the individual who purchases the membership (“member”). It entitles the member to the use of the dining membership only in such a manner as set forth herein. Transfer or assignment of this contract is prohibited. Any exceptions to this contract must be approved, in writing, by the Department of Dining Services. I. This contract, when signed and submitted to the Department of Residential Life, is binding from the time of purchase through the remainder of the academic year and this membership is nontransferable. The applicant acknowledges and agrees to the financial terms and conditions of the University by the submission of an application for membership.
II. The date of membership is defined as the date that block meal and/or flexible dining dollar balances are applied to the member’s account and made available for use by the member. If the membership is purchased prior to the start of the academic year, then the date of membership will be the first day of classes.
III. If prior to the end of the 4th week of membership, a member chooses to cancel their membership and the membership has not been used, the member will be refunded the full purchase price of the membership. After the 4th week of membership or after the first use of the membership then an appeal request must be made with and approved by the Director of Residential Life in writing to cancel a membership and obtain a refund. These provisions hold true unless the student is released from the contract in writing by the Department of Residential Life. Members removed from the University for disciplinary reasons are ineligiblefor membership refunds.
IV. Voluntary Dining Members must present their USM Card, in person, to access their membership benefits. a. Members may use their membership benefits for others at their discretion, provided the member is present and presents their USM Card in person.
V. All Voluntary Dining Memberships balances will be available until they are consumed or the end of the academic year in which they were purchased.
VI. Once purchased, all Voluntary Dining Memberships cancellations and refunds must be requested in writing and approved by the Director of Residential Life.
VII. A Block Meal is defined as access for one person to one of the designated "All You Care to Eat" dining facilities: i. Brooks Student Center Real Food on Campus ii. Portland Hall Real Food on Campus iii.Woodbury Campus Center Food Court
VIII. Refunds for all cancelled memberships will be issued by the Department of Residential Life. U.S.M. does not discriminate on the basis of race, color, religion, gender, sexual orientation, national origin or citizenship status, age, disability or veteran status and shall comply with Section 504, Title IX, and the ADA in employment, education, and all other areas of the University. The University provides reasonable accommodations to qualified individuals with disabilities upon request.
